Terms and Conditions of Service
Please read these Terms and Conditions ("Terms") carefully before using the Forge & Fork website, located at forgeandfork.com (the "Site"), and subscribing to our meal delivery services (the "Service"). By subscribing to our Service, you agree to be bound by these Terms.
1. The Forge & Fork Service
Forge & Fork provides a flexible, subscription-based service delivering pre-portioned ingredients and/or chef-crafted meals ("Products") to your specified delivery address. Our mission is to curate the finest, freshest, premium ingredients to elevate your dining experience.
2. Subscription, Billing, and Payment
2.1. Automatic Renewal
By signing up for the Forge & Fork Service, you are agreeing to a recurring subscription that will automatically renew unless you cancel it in accordance with Section 4.2.
2.2. Billing
You will be billed on a recurring basis (e.g., weekly or bi-weekly) depending on the frequency you select. The exact date of your next scheduled charge is available in your online account. You authorise Forge & Fork to charge your payment method on file for all recurring subscription fees.
2.3. Pricing
Prices for Products and the Service are subject to change. We will notify you in advance of any material changes to the pricing structure.
3. Delivery and Receipt of Products
3.1. Delivery Window
Delivery windows are estimates. Forge & Fork is not responsible for delays outside of our control (e.g., traffic, weather).
3.2. Receipt of Delivery
Our Products are perishable. You are responsible for ensuring the secure and prompt acceptance of the delivery. If you are not present, the delivery will be left at your door, and you assume all risk of loss or damage from that point onward, including but not limited to theft, temperature changes, and spoilage.
3.3. Incorrect Address
You are responsible for maintaining accurate and up-to-date delivery address information. If a Product is lost or spoiled due to an incorrect address provided by you, Forge & Fork will not issue a refund.
4. Subscription Modifications, Skipping, and Cancellation
4.1. Skipping a Week (Temporary Pause)
If you wish to miss a single delivery or temporarily pause your Service without canceling your entire subscription:
You can simply email us (or use the designated "Skip" feature in your account, if available) and we can sort it out for you.
All requests to skip a week must be received before the weekly modification deadline (see Section 4.3).
4.2. Cancellation of Subscription
To stop all future deliveries and charges, you must cancel your subscription entirely.
If you want to end all future deliveries, you must cancel your subscription 5 days before your next scheduled delivery date (the 5-day deadline).
If you cancel after this 5-day deadline, you will still receive and be charged for the next scheduled delivery, and your cancellation will take effect for the following period.
4.3. Modification Deadline
The deadline for all changes, including skipping, meal selection, or cancellation, is 5 days before your next scheduled delivery date. This allows Forge & Fork to manage the procurement of premium ingredients and logistics.
5. Food Safety and Allergens Disclaimer
5.1. Handling and Preparation
You are responsible for safely storing the food upon delivery and preparing it according to the provided instructions, including proper temperature and sanitation practices.
5.2. Allergen Information
Forge & Fork handles and packages ingredients that contain all major US and EU allergens (including but not limited to milk, eggs, nuts, soy, wheat, fish, and shellfish). While we take precautions, we cannot guarantee that any meal or ingredient is free from cross-contamination.
If you have a severe food allergy, you should not rely on Forge & Fork's Service. By using the Service, you agree that Forge & Fork is not liable for any allergic reactions.
6. Intellectual Property
All content on the Site, including recipes, text, graphics, logos, images, and the Forge & Fork name and logo, are the exclusive property of Forge & Fork or its licensors and are protected by copyright and intellectual property laws. You may not use any part of the Service content without express written permission.
7. Disclaimers and Limitation of Liability
The Service is provided on an "as-is" and "as-available" basis. Forge & Fork disclaims all warranties, express or implied. In no event shall Forge & Fork be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Service or any Products, even if we have been advised of the possibility of such damages.
